Terms of Service

These Terms of Service ("Terms") govern your access to and use of Elqar, operated by Elqar (Procity)("we", "us", "our"). By creating an account or using the service, you agree to these Terms.

1. The service

Elqar is a multi-tenant inventory management platform built for hospitality businesses. We provide tools to track stock, manage locations, record movements, raise purchase orders, and monitor alerts across your operation.

2. Your account

You are responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Ensuring your team members comply with these Terms
  • Providing accurate information when registering

You must be at least 18 years old and authorised to enter into contracts on behalf of your organisation.

3. Plans and billing

Elqar offers Free, Pro, and Enterprise plans. By subscribing to a paid plan:

  • You authorise us to charge your payment method on a recurring basis
  • The Pro plan includes a 14-day free trial — no charge until the trial ends
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are not provided for partial billing periods
  • We reserve the right to change pricing with 30 days' notice

4. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorised access to other organisations' data
  • Reverse engineer, copy, or resell the platform
  • Upload malicious code or interfere with service integrity
  • Use the service to store data unrelated to inventory management

5. Your data

You own the data you input into Elqar. We do not sell your data to third parties. We process it solely to operate and improve the service. On cancellation, you may export your data. We retain it for 30 days after account closure before permanent deletion.

6. Availability and uptime

We aim for high availability but do not guarantee uninterrupted service. We may carry out planned maintenance with reasonable notice. We are not liable for losses caused by downtime, data loss, or service interruptions beyond our reasonable control.

7. Intellectual property

Elqar and all associated software, design, and branding are owned by Elqar (Procity). You are granted a limited, non-exclusive licence to use the platform for its intended purpose. This licence does not transfer any ownership rights.

8. Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or entirely secure.

9. Limitation of liability

To the maximum extent permitted by law, Elqar (Procity) is not liable for indirect, incidental, or consequential damages including loss of profits, data, or business arising from use of — or inability to use — the service. Our total liability in any 12-month period shall not exceed the amount you paid us in that period.

10. Indemnification

You agree to indemnify and hold Elqar (Procity) harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may cancel your account at any time from within your billing settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity. On termination, your access to the service ends immediately.

12. Changes to these terms

We may update these Terms from time to time. We will notify you by email and/or in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
